Thoughtful, experienced counsel
for New Jersey families and businesses — with the personal attention you won’t find at a high-volume firm.

New Jersey Family Law Attorneys Who Balance Strong Advocacy With Real Compassion

Family legal matters touch the most personal parts of your life, and they call for attorneys who combine skilled advocacy with genuine compassion. We represent clients throughout New Jersey — including Passaic, Bergen, Essex and surrounding counties — in divorce, custody, support and related matters. Our approach pairs firm representation with the patience to listen and the care these situations deserve.

You will not be a case number here. At the Law Offices of Peter G. Aziz & Associates LLC, we take the time to understand your family, your priorities and what a good outcome looks like for you, and we work to reach it while keeping conflict and cost as low as the situation allows.

Our Family Law Services

Our attorneys provide strategic counsel across a full range of family law matters, including:

  • Divorce: Contested and uncontested divorce on fault and no-fault grounds, including equitable distribution and alimony.
  • High net worth divorce: Complex asset division, business valuation and protection of separate property.
  • Child custody and support: Legal and physical custody, parenting time and support under New Jersey guidelines.
  • Post-judgment modifications: Adjusting orders when life circumstances change.
  • Restraining orders: Seeking or responding to protective orders.

Whether you are facing a straightforward uncontested divorce or a high-conflict custody dispute, our team will bring the dedicated advocacy your family needs.

Divorce in New Jersey

New Jersey recognizes both fault and no-fault grounds for divorce. The most common ground is irreconcilable differences lasting at least six months (N.J.S.A. 2A:34-2). New Jersey is also an equitable distribution state, meaning courts divide marital property farily based on the circumstances of the marriage, which does not necessarily mean an equal or 50/50 split (N.J.S.A. 2A:34-23.1).

Under N.J.S.A. 2A:34-23, alimony depends on statutory factors such as the length of the marriage, the standard of living, and each spouse’s earning capacity. We will guide you through each step and, in high net worth cases, address business valuation and complex assets while working to control the emotional and financial toll.

Child Custody and Support

When children are involved, their well-being is the court’s central concern. New Jersey distinguishes legal custody (decision-making authority over matters like education, health care, and religion) from physical custody (where the child primarily lives). Courts apply the best-interests-of-the-child standard and weigh the factors in N.J.S.A. 9:2-4, including each parent’s fitness and stability, the family history, and, where appropriate, the child’s preference. Child support follows the New Jersey Child Support Guidelines, based largely on income, parenting time, and the children’s needs. We help establish, modify and enforce these arrangements with your children’s best interests at the center.

Frequently Asked Questions About Family Law in New Jersey

Family law issues often involve difficult personal decisions and complex legal steps. To help you understand what to expect, we have answered several common questions about the family law process below:

When should I hire a family lawyer?

You should consider hiring a family lawyer if you are facing divorce, a custody dispute, a domestic violence situation or a question of paternity. Early representation often prevents costly mistakes and protects your rights from the start.

What does a family law attorney do?

A family law attorney provides advice, prepares documents, negotiates on your behalf and represents you in court. Our attorneys also offer mediation, help set fair support arrangements and work to resolve disputes efficiently while protecting your interests.

How is property divided in a New Jersey divorce?

New Jersey uses equitable distribution, dividing marital property fairly based on the circumstances of the marriage rather than automatically splitting everything down the middle.
