Understanding The New Jersey Probate Timeline

The timeline in probate is well-defined, and your duties as executor are clearly outlined in the law. The process is:

  • After someone passes, you must wait 10 days before bringing the estate to the County Surrogate court for processing.
  • At the court, you must present the letters testamentary that identify you as the executor.
  • Resolve the taxes and debts of the estate. New Jersey inheritance taxes may require you to pursue tax waivers to clear liens on any real estate
  • Distribute assets to the heirs.

Closing the probate process is dependent on securing a Refunding Bond and Release document from all the heirs that receive their inheritance. This will absolve you of any liability should a dispute later arise about the handling of the estate by any of the heirs.
